ds of thousands of people coming here to witness president obama take the oath of office for a second time. >> reporter: president obama made the short trip across lafayette park to attend a service at st. john's church. >> if anybody has tickets give me a shout out. >> reporter: as many as 700,000 people are expected to fill the national mall to watch the inauguration. darrell came here from jackson mississippi. he camped out overnight hoping to get a good spot. >> i'm going to be sitting right there waiting for when they open up. >> reporter: thousands of law enforcement officers and federal troops from around country will be on hand to make sure everyone is safe. today's swearing in on the steps of the u.s. capitol is ceremonial, held for the public. the constitution requires that the official swearing in take place on january 20th. >> i barack hussein obama do solemnly swear. >> reporter: he followed that

up with a candlelight ceremony sunday night where he said today's parties are not about him. >> what we're celebrating is not the election or swearing in of a president. we're doing celebrate aring each other. >> reporter: and he talked about the most significant of the weekend, he talks about his wife's haircut. >> i love her bangs. she looks good. she always looks good. >> reporter: and it won't end until late monday night when they attend three different ball. and more than a couple hours away before the ceremonies begin. president obama is only the 17 17th president to have a second inaugural. alternate the u.s. capitol, susan mcginnis, back to you. >> thank you so much. and of course cbs news will provide live coverage of today's inauguration festivities, it begins on cbs 5

and will run until 1 in the afternoon and no noon newscast today. cbs 5 will have reports from christin ayers in washington in the next half hour and during our 5 and 6:00 newscasts this evening. it's 42 lovely degrees in washington right now. >> it's so cold there. >> chilly out there. chilly around the bay area. we have numbers around the 20s and 30s and by the afternoon we have sunshinecoming our way. enjoy it, we have big changes coming our way. outside, satellite image, high pressure sliding further to the east now. the last couple of days, the real nice weather outside. by the afternoon, we're enjoying plenty of sunshine. very mild temperatures. right now, it is 28 degrees. in santa rosa and by the afternoon, hazy sunshine for everyone, these temperatures running up well into the 60s.

65 in redwood city and 63 degrees in san francisco. we could have rain coming our way. let's check out the roads. and still watching a couple problems on the road including this traffic alert still indicate on northbound 880 by washington. one lane is blocked. has been blocked for nearly an hour now where they had that traffic alert. so again, just minor slowing because it is a high school uh- huh day. there's not as much traffic on the roadway. -- because it is a holiday. there's not as much traffic on the roadway. and we have a power outage, on school road toward alpine road. we don't know if there's any power outages in the area. just a heads up. mass transit, b.a.r.t. on a typical holiday schedule. everything is on time. b.a.r.t. and muni ferries and ac transit buses on time. and a look at the south bay

from san jose. 101 from the mckee exit, and still moving at the limit from san jose and santa clara. and here's a look at the nimitz, 880 near the oakland coliseum. and past washington, everything improves toward oakland and the macarthur maze. that's traffic, back to you. there was a little football game played overt weekend. the 49ers -- over the weekend and the 49ers won it and will go to the super bowl. >> cate cauguiran is in san francisco. is the celebration still going on out there. >> reporter: well, i think people are kind of taking their break right now. once daylight heat -- hits you'll see the red and gold. i don't know if any parties could rival the spirit and celebration we saw with last night's win. the san francisco 49ers did

come home last night, here they are arriving into the san jose's airport, and by the time they got back into the bay area, celebrations were in full swing. people were delirious with joy and in minutes of the win, super bowl t-shirts were on the streets. some of them were going for 20 bucks a pop. >> we got that. we're going to the super bowl. and the stingiest defense until the nfl, this is smith's wrecking company. >> reporter: throughout the city, san francisco police were keeping a close eye on public drinking. officers made sure they confiscated any liquor out in the open but they say all they had was maybe about a handful of arrests. here's a little bit of super bowl trivia for you, and i know again, frank is probably well aware of this. san francisco is hoping to be the first market to win both a world series and a super bowl in one season since the boston

say b it. it was great performance. >> reporter: it was the biggest come back in the history of the nfc championship game. the 49ers spotted him 17 points. and got it done. they earned a right to sleep in late today i think we'll let that go. in atlanta, the georgia dome, vern glenn, cbs 5. >> a win is a win. thank you vern. investigators say an atlanta punched an 49er fan and the 49er fan stabbed him in the neck. the falcon fan transported to the hospital. no word on an arrest. his not known. jim harbaugh will be going against his brother. they had to go against john harbaugh to get there and it was a dog fight for most of the game but ultimately the ravens beat new england 28-13.

transiting including muni, golden gate ferries and ac transit on the east bay, on a typical saturday or sunday schedule. we're still watching this traffic alert. one lane is still blocked northbound 880 approaching washington street. we are really not seeing much of a delay. it's because there's just not as much traffic on the roads. a lot of schools are out. no postal service today. power lines down. this is another problem we're watching on city streets attarton avenue remains shut down. a car hit a power pole in the area. we're waiting for word from pg&e to see if there's any delays or power outages in the area. that stretch of road is closed. let's show you the live traffic cameras, a live look at the bay bridge toll plaza, an easy compute so far into san francisco, similar story at the san mateo bridge both directions. that's a check of time saver

traffic. more on the gorgeous weather, keep it. enjoy it though, things are about to change drastically. mostly clear skies around the bay area. cold temperatures are beginning to creep a little bit closer. the ridge of high pressure slides east ward, and another nice day outside. mild temperatures in towards the afternoon. hazy sunshine toward the coastline and big changes toward the middle of the week. maybe we talk about rainmaking return. temperatures cold under mostly clear early on today. 30 in concord. 40 in san francisco and 31 in livermore. ridge of high pressure nudging its way east ward and before long one of the o storms is going to punch right through and could see showers as early as wednesday. traveling out of sfo, hazy sunshine, no delays expected

there. across the country, it is cold in spots, especially as you make your way into chicago. only 11 degrees expected there. snow in new york, 35 degrees and. partly cloudy in houston. around the state we'll find temperatures until the 60s in the central valley. 70s in the monterey bay. our temperatures looking good. plan on 60s there in the south bay. east bay temperatures low to mid-60s and inside the bay we'll keep the temperatures on the mild side. mid-60s into the afternoon. next couple of days, lots of sunshine. wednesday, the showers return and could get unsettled, possibly wet next weekend. >> enjoy monday and tuesday then. >> soak up all the sunshine while you can. 6:17, marin county gun buy back program is a victim of its own success when weapons are handed in today. vouchers instead of money. all the money was used when 827 weapons were given up. the buy back today is at the police station's in san rafael,

and you can turn them in navado point and hours are from eleven this morning until 8 tonight. other headlines, san leandro police are looking for suspects, a 50-year-old man was killed and a woman wounded after they were caught in the cross fire of two rival groups on saturday. one person is in custody. and work will begin this week to repair fender damage when a tanker sideswiped the bay bridge crews will begin replacing some of the damaged fender sections which are made of steel and recycling plastic. they absorbed the impact. there was no structural damage. repairs will cost about $3 million and should take about 4 months. in about three hours, the freedom train celebrating the birthday of martin luther king travels from san jose to san francisco. >> it's a way to educate the young about past civil rights

struggles. elissa harrington is in san jose with more on how people can ride. good morning. >> reporter: the longest rung freedom train in the united states going on its 27th year now, and it leaves the station in san jose at 9:30 this morning. it's to commemorate the birthday of martin luther king junior and covers 54 miles. that's the same distance that he and other civil rights activists marched in 1965. he led thousands of demonstrators from sell e sell -- selma alabama to montgomery. this is significant considering obama is being sworn into his second term in the white house. the mlk association is chartering the freedom train and to ride you needied to get your tickets online at brownpapertickets.com or you can buy one on site from the

the sacramento kings will become the new seattle supersonics. it's 6:24, new reports this morning that the sacramento kings will become the new seattle super sonics sources familiar with the decision tell the ap that the ma loof family is selling the entire stake in the team to a seattle investment deal. and a great weekend for bay area sports fans and a local surfer is victorious at mavericks. they went head to head at half- moon bay. viewing was restricted to a hotel parking lot after authorities closed the beach and bluffs because of safety concerns. but thanks to a camera, the 30,000 spectators got close up experience and it was great. >> when they put it up a few minutes ago, i heard the people. it's freaky.

and it's t just show es -- shows the awe f of how big it is. the winner, 43-year-old peter mel. and followed by zach and grant long coming in third. surfing is back. so is hockey. >> that's right. if the sharks opening game performance is any indication of the entire season, it was worth the wait. patrick marleau had two goals as san jose overcame an early 1- 0 deficit and beat the flames 4- 1. they play edmonton tomorrow and have their home opener on thursday. play of the day, why not, frank gore, a couple of touchdowns and this one simple but it gave the 9ers the lead in the game after going down big time until the first half. they went onto beat atlanta and face the ravens in the super bowl february 3rd and better yet, we'll be remining you.

>> the 49ers are going to the super bowl. >> well, it wasn't an easy start but what a finish. the 9ers get the first super bowl berth in 18 years after beating the falcons by four. another big day of celebrations in our nation's capitol. this is a live look at the crowds gathering at the national mall to witness president obama's second public oath of office. and the big day is already under way for president obama, his wife michelle, daughters sasha and malia, they are taking part in the inauguration day celebration. located by lafayette park and. vice president biden and his wife jill are attending. and the vice president and president have already gone into their second term. >> i do solemnly swear. >> chief justice john roberts administered the oath to the president yesterday during brief ceremony in the blue room of the white house followed by

another small ceremony last night. >> what we're celebrating is not the election or swearing in of a president. what we're doing is celebrating each other. >> vice president biden took the official oath yesterday administered by sonia sotomayor. it requires that the president and vice president take the oath before noon eastern time on january 20th. according to tradition, if the o 20th falls on a sunday, a public swearing in and most festivities take place on the 21 21st. cbs 5 christin ayers is washington where today's events are taking on special significance on this martin luther king holiday. >> reporter: when he was sworn in it will be before a crowd that's nearly half the size of his 2009 inauguration. but this inauguration will have its own historical distinction.

it will happen on the national mall where 50 years ago martin luther king gave his historic speech her, not lost on bay area people we tracked down. anybody from california. >> i used to be from are california. >> reporter: this former san francisco man believes it's a perfect storm. >> to have the con influence of everything happening with 50th 50th anniversary of dr. king's speech and the 150th 150th anniversary of the emancipation proclamation. i think it's great and i just find it so fitting for the second inauguration, this administers and for what our country need today. >> this is history. it will always be in the history books. >> reporter: mr. obama, beverly mckinney sees living proof of dr. king's dream realized. >> you as an individual have the opportunity to make a difference in this world. if you don't do that, it was

all nor naught. >> reporter: a message these former southern californians say has inspired own family. their son won the presidential award for academics and a trip they hope will stay with him forever. >> i tell my son, strive for the best, maybe you could be the first hispanic. >> and christin ayers is in washington for this morning's inaugural event. >> and she joins us by the phone from the national mall where the stage is set and security is mighty tight as well. good morning, give us your impressions. you've been there i would imagine several hours so far just going through security and whatnot, right. >> reporter: that's right, we have been here for hours and security is tight. we stood in line for about 3 1/2 hours trying to get through a media entrance and were later let through along with the rest of the general public. a chilly morning standing out and waiting for the gates to open. we did finally get in and now they're in the crowd that's estimated to be anywhere from

700 to 800,000 people gathered on the national mall and now waiting for the inaugural ceremonies to begin. this is a much smaller crowd than we saw in 2009. in fact, we hear it could be estimated as less than half of the number of people, but an enthusiastic call all the same, a sense of calm as people are watching and waiting and milling around enjoying what is turning out to be a slightly warmer day than it was earlier this morning. and definitely a bit of excitement in the air here as we're walking around and just waiting for these inaugural festivities to begin. >> we can imagine. you know, as you're talking we're taking a live look and we see some singers, very young singers part of a chorus here. tell us about the entertainment we can expect the rest of the. >> reporter: i think the

biggest buzz we've been hearing about is beyonce singing the star spangled banner. we were at the mall yesterday and we're hearing the symphony playing and practicing at dress rehearsal and sounded absolutely beautiful. certainly that is really going to be a highlight here. i think there is definitely a very festive summary -- atmosphere out here and people are looking forward to hearing and enjoying and hearing mr. obama's inaugural comments. >> christin ayers live for us in 45-degree are washington d.c. on what should be a historic and a lot of fun. enjoy your day. thanks so much for the live report. >> thank you. >> and remember cbs 5 will have reports from christin ayers in washington during our five and six newscast this evening. you won't want to miss. that and cbs news will provide

fremont, 65 in oakland, and 63 in san francisco. and we could have rain coming our direction. let's check out the roads with elizabeth. we are expecting lighter traffic overall. we have banks and post offices and a lot of schools off today. not as many cars on the road. you can see it if you look at the traffic sensors and live traffic cameras. this is 101 to the mckee exit. both directions still moving at the limit. let's go to the map, watching the traffic alert, northbound 880 approaching washington street. all lanes back open. it's a little sluggish on 238 but not much. further up the nimitz, later on this afternoon, warrior play the clipper at 1:00 so could get a little busy. right now you are good to go. one more game left in the nfl season and the 9ers are in that game. of course the super bowl on cbs

5 cate cauguiran here in the city as fans look forward to the big day in 13 days away: >> reporter: we're all counting down because this morning these 49ers fans are going o to wake up because the super bowl dream is a reality. and we have our eye on a 6th 6th super bowl win. last night, the 49ers did get back in the bay area landing at san jose's manetta airport, they came back to a city bleeding red and gold. take a look right there. crowds spilled into the streets. cheers and chants throughout the city and didn't take long for the super bowl t-shirts to hit the street as well. one guy was selling them for 20 bucks a pop. >> we're going to the super bowl and the stingiest defense in the nfl, mr. smith's wrecking company. >> police did keep an eye on

fans and public drinking. officers at times confiscated any liquor consumed in the open and they only made a handful of arrests last night. here's 9ers super bowl trivia, this is the first time we'll be playing in the game since 1995. reporting live in san francisco. cate cauguiran cbs 5. it was a real come from behind effort for the 49ers. >> yeah, we had to kind of sweat this out. they were down 17-0. finally got it together and came storming back to complete the 4 4th quarter come back here, and frank gore scored what looks like an easy touchdown here, putting the 9ers ahead for the first time in the 4th quarter. and the defense shut out the falcons in the second half and that was your ball game. >> the best day of my life was when my kids game. it's been a long time. we came that long way as a team from being the last, to now we're going to the super bowl. a lot of relief from frank

california's budget picture is ing a lot rosier. governor brown's prop 30 tax measure is in effect in california's budget picture is looking a lot rosier. >> it does, but there's some question now about how the governor got it top billing on the ballot. here's melissa griffin. an appeals court has ruled on a sneaky move by the governor. >> exactly. there's a reason why his measure was the top of the

ticket. and molly monger's competing tax measure was far down on the ticket. and they revealed it was a abuse of power. generally the conventional wisdom is things at the top of the ballot have a better chance of passings, the further down they get on the ballot, they are more likely to vote no or not vote. how do we decide what order things go on the ballot. traditionally it's been determined by who gets their signatures in first. in last year's election, the pta backed income tax for education got their signatures in first so they should have been at the top of the ballot. jerry brown was in a pickle. he needed his prop 30 on the ballot and needed pull position. what was he going to do. he needed to pass a law. most laws go into effect the year after it's enacted.

he needed to pass a law that's enacted immediately. here's what democrats in sacramento did. they created a 1000-dollar appropriation, slapped it onto a bill that would put jerry brown's bill at the top of the ballot and passed it as a budget bill because budget bills go into effect immediately. of course when this happened the taxpayers association went to court and said absolutely, this is totally abusive, there's no way you can slap money onto the unrelated bill, say it's for a budget. and make it immediately. they said they're not going to stop the election from going ahead to the current system and on friday, third circuit appeals court ruled that what happened here was an abuse of process and should not happen again. >> what happens to the bill that puts constitutional amendments at the top of the ballot. >> it should be voided. they didn't say specifically but they did say it was

entirely unconstitutional scenario and said that should actually make the law that ordered things on the ballot differently null and void. >> a lot of politics in the politics. is it retroactively back to november. >> unfortunately the election results stand but this is a going forward basis and not going to be able to do this again. they have to make sure budget items are budget related. and we are sell bright the -- celebrating the president's inauguration and there's controversy over champagne. >> some folks who have basically the best job ever working for the champagne bureau is what's going to be served as the california dinner is california champagne and they say the only champagne that's real comes from that region. the united states allows champagne to be used as a

future. we start to talk about a return of rain as we head toward the middle of the week. nice and clear. 30 degrees in concord. 28 and cold in santa rosa and high pressure and sliding east ward as the ridge moves out of the way. things going to change here quite drastically. the sunshine at sfo, no problems there. if you're heading across the country, snow and cold temperatures and windy conditions and 11 degrees in chicago for today. 72 degrees in the monterey bay. around our bay temperatures in the 60s. east bay probably low to mid- 60s and inside the bay, about 65 degrees in oakland. 63 in san francisco. next couple of days, looks like nice weather a a chance of showers. wednesday, possibly more showers over weekend. let's check on the roads with elizabeth. we're doing great if you're heading towards the bay bridge. this tells the traffic story. it is martin luther king holiday so banks and schools

friday while the nasdaq lost a point. and this morning, a freedom train on the martin luther king holiday will depart from san jose and travel up the peninsula. >> on its way to commemorate the civil rights movement and elle zillion down in san jose with more on how people can get aboard that train. >> tickets are still available, $10 a piece, and can only get them at one of four caltrains stations. it takes off from san jose at 9:30 this morning. boarding starts at 9. it makes three stops on the peninsula. in sunnyvale, palo alto and san mateo. you can get a ticket at any of the locations locations and then the train ride ends in san francisco at 10:55. it's to honor the birth of martin luther king and covers covers 54 miles. that's when he led thousands
